Until the Judiciary starts tossing frivolous lawsuits out and requires the plaintiff to reimburse the defendant for his costs in such cases and our civil litigation rules change to the point where plaintiffs are required to reimburse defendants whenever they fail to prevail in such litigation these types of lawsuits will continue to clog our court calendar and we’ll see these nuisance legal actions continue as well.

Ridiculous. But nothing new.
I’m with you that this and many suits are crazy. Many do get tossed and fee shifting exists in many places; take NI’s offer of judgment rule. the right to courts in our country is what separates us from many other countries. we value property rights unlike others. I agree that personal injury suits sometimes get out of hand; no denying that; but a lot of good comes from these things. I have seen gruesome injuries ruining careers because of bullpens in foul territory; is it really bad if owners pony up more cash to protect its product? If you want to talk class actions, should a company like a big bank rake in millions by skimming with horseshit charges? The answer is no. If we didn’t have class actions nobody would sue for $150 in damages; but group people together, the bank’s bad practices will stop. Or one individual’s suit against a car manufacturer for faulty breaks....a class action will get a manufacturer’s attention.

the other alternative is to regulate more. while I know many personally who would profit from that, I’m not a fan of bigger govt
