I think the spirit of this legislation is a good one. Terminal patients should have the opportunity to try drugs that are not yet FDA approved. With that being said, the devil is in the details.

Patients do have access today through a program called "compassionate use", but there is a lot of red tape and involves an FDA panel to review, which when a patient is terminal with maybe weeks to live only goes so far. My wife has worked in pharma clinical ops (most of it in oncology) and she would get calls from patients that would get through begging to get in a clinical trial as a last resort. Heartbreaking stuff. The counter arguments to this bill made no sense. Actually Mike Pence had actually spearheaded legislation in Indiana when he was Governor.
