I think the quote is taken a bit out of context. I am no fan of Scalia but I want to be fair. He offered it up as a possible alternate argument. The exact quote is "

“One of – one of the briefs pointed out that – that most of the – most of the black scientists in this country don’t come from schools like the University of Texas. They come from lesser schools where they do not feel that they’re – that they’re being pushed ahead in – in classes that are too too fast for them.”
I actually don't have a problem with this. I think open debate is good. If you disagree, great state your reasons why. But to dismiss as being racially insensitive, I don't buy it. While politically I lean liberal, I think the far left liberals are in favor of censorship in the name of political correctness which I vehemently oppose.
