All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. Why do I get the sense that some of the so-called Textualists on the Supreme Court are going to decide it's actually not unconstitutional?
Here's the comedy of it. The parents are illegal aliens. ILLEGAL is the key word. Do you send them to jail and let the child raise himself or herself? ILLEGAL has to matter. You get chaos when you don't punish illegal activities. The EO is stupid but come down harsh on the illegal aliens. Make them not want to come here and give birth.
I am completely opposed to it as well. But I'm also opposed to illegal aliens coming here just to give birth. Punish the illegal aliens. THEY ARE ILLEGAL.

That's the question which will decide whether this is constitutional or not. Are illegal aliens and their offspring considered "persons?" That's for the courts to decide.
I think this should be done through the constitutional process, certainly not through executive order. I do support ending it only for children of illegal aliens. The parents should have to be legal citizens in order for their children to be granted US citizenship.
The court has been pretty clear there already and it's not really a close call. If a person is in the US, under US jurisdiction and has a child, the child is a US citizen.

I think the amendment is no longer serving the purpose it was intended for and it should be amended.
Why do sympathizers on this issue always default to, "but, but, but!, they did this! They did that! They're productive!" If they're so smart and productive, take the time to become a citizen. It's not that hard. That's all we ask - become a legal US citizen. Get in line and do it the right way.
Good segment on NN (Cuomo) tonight with Steven A Smith and Bill O’Reilly discussing EO identifying cartels as terrorist organizations. Freezing assets and US military actions…bold move if Trump pulls the trigger, and it would paralyze dealers in U.S.
the right way? she is a US citizen. the way it states in the 14th amendment. seemed right and all checked out.

Most of these EO’s were done to publicly thank his base. Such is the case with recent Presidents but Trump takes it to another level.

At the end of the day it will be about results. But this is why Trump got elected. Why anyone would be surprised?
YES you get it now. Go through the process the right way. Whether it's entering the country or changing an amendment. Do it the right way. Don't show up here illegally and have a kid. It's not like you don't know when the 9th month is.
There are many things that can and should be done in regards to immigration reform but I am adamantly opposed to ending Birthright Citizenship.
It's unconstitutional. We all know that. This is just a power move on the first few days. Birthright citizenship is a loophole for illegals to come in and stay. This is a power move to show he will go as far as he possibly can to go after illegal immigrants, because you knowknow, they're ILLEGAL.

I disagree with the Reverend. Last time I checked it is a crime to come here illegally. They're not all bad people. They are not all violent. They're all not looking to harm someone. But get out and come in the right way. Why is that so difficult? Millions of people did it the right way. I can't just walk onto the Harvard campus and start taking classes because I think I belong there. God knows I don't. You apply, you get in or you do not get in. Heck why is there a guard and a gate at Seton Hall, just let everyone in. If the experiment goes well at Seton Hall then lets bring the success to the attention of the people in Washington DC.
Not as easy as you might think. Get rid of criminals that’s something most can agree makes sense. I believe people who are here working and obeying our laws should have an opportunity to become citizens. They were encouraged to come here. Why should they live in the shadows. Both parties had a chance to bring people out of the shadows but choose to leave them there to be taken advantage of in employment opportunities. Modern day slavery.
I am in agreement with all of that. I think we should treat those who are here with dignity and offer a path to citizenship.. I'd understand why if they have been here for years and have children that their children should be citizens but I do not understand why a woman from South America could cross the border tomorrow, have a child, and that child gets citizenship.
While the 14th amendment was written in a way to make that possible, that is not what it was intended for.
Please enlighten. For what was the intended purpose of the 14th amendment and how does it apply to a path of citizenship for those who decided to skirt our immigration process. I find it hard to believe that was part of what it was intended for. I’ve heard of the new math kids are learning but I guess there’s new history too.

This is simply a continued expansion of the power of the presidency that has been going on for decades. We need to have them stop ruling by executive decree.

No, it refers to people who can't make a single statement without bringing him up and criticizing him for something. Trump lives rent free in these people's heads. It's an obsession. I know people in my real life who suffer from this (without knowing it, of course. they deny it) and it's sad to watch. A result of the social media age where everything political is amplified and people just have to have an opinion on every single issue that follows the party line of whatever they subscribe to. Their intention 150+ years ago on what to do with children born from freed slaves has little to do with my views on what we should do today with the millions of illegal immigrants in the US.
I believe the 14th amendment was useful at the time but should be eliminated AND I believe that we can approach this issue with compassion and empathy. Allow those who have been here for years and are productive members of society to stay here and let them earn citizenship while making the border more secure from here.

Crossing the border to have babies is not what the 14th Amendment was intended for, but some people will always try to game the system. This problem can be mostly eliminated without ending Birthright Citizenship.
